The instruments that govern employment of staff in long day care are:
- The Fair Work Act 2009 (incorporating the National Employment Standards (NES))
- The Children's Services Award 2010 (CSA)
- The Educational Services (Teachers') Award 2010 (ESTA)
You should know your way around these instruments, including the schedules - e.g Schedule B of the CSA which sets out indicative duties for each wage level.
You are required by law to have a copy available for your staff to be able to access if they want (electronically or printed).
To enable you to quickly and accurately determine your employees' wage rates, ACAV provides a wage table for each of the awards (see link below).
National Minimum Wage decision
On 19 June 2020, the decision was made to increase the national minimum wage together with all Modern Award minimum rates of pay, by 1.75%.
If you pay your employees at the National Minimum Wage or Modern Award rates of pay, you needed to apply the increase in the first full pay period on or after 1 July 2020. Updated wage tables are available below.
Please note, the ESTA rates for CASUAL ECTS working in a service operating more than 48 weeks a year were INCREASED BY 4% with effect from 1 October. Adjusted wage tables are available below. (added 16 October 2020)

National Employment Standards
From 1 January 2010, employers and employees in the national workplace system are covered by the National Employment Standards (NES).
Under the NES, employees have certain minimum conditions. Together with pay rates in modern awards (which also generally take effect from 1 January 2010) and minimum wage orders, the NES makes up the safety net that cannot be altered to the disadvantage of the employee.
The NES include minimum entitlements to leave, public holidays, notice of termination and redundancy pay.

From 1 January 2010, this Fair Work Information Statement is to be provided to all new employees by their employer as soon as possible after the commencement of employment. The Statement provides basic information on matters that will affect employment.
